Terms & Conditions
These Terms of Service for Digitronix LLC (this “Agreement”) constitute a legal agreement between you (either an individual or an entity that you represent, hereinafter “you”) and Digitronix LLC and its suppliers and licensors (collectively “Digitronix LLC”) for the Digitronix LLC Services (“Services”). By applying for, using, or purchasing the Services, or by accepting this Agreement, you acknowledge that you have read, understood, and agreed to the terms and conditions stated herein. If you do not agree, do not apply for, use, or purchase the Services. The Services include new products, updates, upgrades, support, and other offerings. You may receive the Services only if you are a subscriber in good standing with a valid account with Digitronix LLC. The Services are available for a limited time, and failure to use them within the subscription period does not entitle you to any refund.
Definitions
Content
Software, materials, services, and related information are collectively referred to as “Content.”
You
Refers to you individually or any person or entity you represent, including your employer.
Services
“Services” refers to Digitronix LLC’s support services, including chat and phone-based computer optimization and PC cleaning services as described on its website. These include virus diagnosis and removal, PC tune-up, internet security, email setup, software installation, printer setup/support, and general troubleshooting. The scope may change without notice, and Digitronix LLC may modify or discontinue Services at its discretion.
“Software” refers to any software used in connection with the Services.
Subscription Period
The time during which the subscriber is eligible to receive Services, starting from the date of subscription and ending as per the selected plan.
Plans
Subscription-based or incident-based plans offered by Digitronix LLC for a defined duration.
General
Technical support is provided via phone, chat, and secure remote access. By using the Services, you authorize Digitronix LLC to configure your computer, delete unnecessary files, and modify system settings (including registry changes) as needed. You also permit installation of required software.
Access
To deliver Services, Digitronix LLC requires internet access to your system. A high-speed connection is recommended. You are responsible for providing access and cooperation during troubleshooting. Failure to cooperate may be considered a breach of this Agreement. You must have administrator rights, maintain data backups, and provide accurate information.
Credit Card Billing
You may be required to provide valid payment details to activate Services. You authorize Digitronix LLC to charge your credit/debit card for applicable fees. Charges may continue until all dues are cleared. You agree to update payment information when necessary. Digitronix LLC is not responsible for insufficient funds or related charges. Additional fees (e.g., $15) may apply for failed transactions.
Refund Policy
- For subscription plans: A full refund will be issued if no issue is resolved within the first 30 days.
- If at least one issue is resolved, fees are non-refundable. Partial refunds may be granted at Digitronix LLC’s discretion.
- For incident plans: Refunds apply if:
- The issue is out of scope
- 30 days have not passed since last service attempt
- The issue remains unresolved during the active period
Digitronix LLC does not store credit card information and will not charge without consent. Plan changes may be accommodated upon request.
Limitations
Services do not include data recovery, hardware repair, or compensation for lost data, profits, or files. Digitronix LLC does not guarantee against data loss. You are responsible for backups.
Term and Termination
This Agreement is valid for up to 12 months for subscriptions. One-time services end after completion. Digitronix LLC may terminate Services if usage is excessive or inappropriate. No refunds will be issued upon termination due to breach.
Disclaimer
All software is provided “as is” and used at your own risk. Digitronix LLC does not guarantee error-free operation or performance. To the maximum extent permitted by law, all warranties express or implied—are disclaimed, including merchantability and fitness for a particular purpose.
Limitation of Liability
Digitronix LLC and its affiliates are not liable for any direct or indirect damages, including data loss, service delays, unauthorized access, or third-party issues. Total liability shall not exceed the amount paid for Services.
Force Majeure
Digitronix LLC is not responsible for delays caused by events beyond its control, including natural disasters, war, strikes, or internet failures.
Governing Law
This Agreement shall be governed by the laws of the United States.
Entire Agreement
This Agreement represents the complete understanding between you and Digitronix LLC. Changes may be made at any time and will take effect upon posting. Continued use of Services implies acceptance of updated terms.
General Information
These Terms, along with the Privacy Policy and related agreements, govern your use of the Services and supersede prior agreements. If any provision is deemed invalid, the remaining terms remain enforceable. You may not transfer your rights without written consent. Section headings are for convenience only.
